Time limit to lodge protests against the validity of the elections to the Sejm and the Senate has begun to run - it expires on 25 October 2023

On 18 October 2023, the results of the elections to the Sejm and the Senate held on 15 October 2023 were published in the Journal of Laws of the Republic of Poland. Therefore, a 7-day time limit to lodge a protest with the Supreme Court against the validity of the elections has opened. It expires on 25 October 2023.

The protest against the validity of the elections must be lodged in writing. The protest may be lodged directly with the Supreme Court, sent at a Polish post office (Poczta Polska), lodged with the territorially competent consul or shipmaster. Lodging of a protest in a form other than in writing, i.e. by fax, e-mail, or ePUAP, is not admissible.

A protest against the validity of the elections, in order to be examined on its merits, must include:

  • identification of the entity lodging the protest with the address and PESEL number;
  • indication of the polling district in which electoral register the name of the person lodging the protest was included;
  • request for a declaration of invalidity of the elections/elections in the particular district, or of the election of the particular MP or Senator;
  • allegations:
  • reasons for the allegations,
  • presentation or indication of the evidence on which the allegations are based;
  • handwritten signature of the person lodging the protest or his/her representative.

If the protest is lodged by a person staying abroad or on a Polish sea vessel - the protest must ADDITIONALLY include:

  • identification of a representative resident in Poland or a representative for delivery resident in Poland with the indication of respective address (the document authorizing to represent the voter should be attached to the protest).
