The Supreme Court, sitting in a bench of 7 judges, adopted a resolution concluding that in proceedings initiated by protests against the validity of elections: to the Sejm of the Republic of Poland and to the Senate of the Republic of Poland, to the President of the Republic of Poland, as well as to the European Parliament in the Republic of Poland, as referred to in the Act of 5 January 2011- Electoral Code (EC), and also in proceedings initiated by a protest against the validity of a referendum, as referred to in the Act of 14 March 2003 on a nationwide referendum (NRA), the provisions of Article 130(1-2) and Article 130^1a(1-3) of the Act of 17 November 1964 - Code of Civil Procedure (CCP) shall not apply.

On 6 October 2023, the Supreme Court dismissed the complaint of the election representative of the KKW Trzecia Droga Polska 2050 Szymon Hołownia - Polskie Stronnictwo Ludowe against the resolution of the National Electoral Commission (PKW) on the guidelines for district electoral commissions on the tasks and procedure of preparing and conducting the voting in polling districts established in the country in the elections to the Sejm and the Senate of the Republic of Poland and in the nationwide referendum scheduled for 15 October 2023.

On 5 October 2023, the Supreme Court examined whether the entity entitled to lodge a complaint against the resolution of the National Electoral Commission regarding the guidelines on the tasks and procedure for the preparation and conduct of voting in the nationwide referendum is a community organisation whose statutory objectives are concern for democracy, civil rights and the development of civil society, in a situation where it does not participate in the referendum as an entity entitled to conduct a referendum campaign, as referred to in Article 48(1) of the Act of 14 March 2003 on the nationwide referendum.

On 5 October 2023, the Supreme Court ruled on the complaints against the guidelines of the National Electoral Commission (PKW) for the district electoral commissions on the tasks and procedures for the preparation and conduct of voting in the polling districts established in the country in the elections to the Sejm and the Senate of the Republic of Poland and in the national referendum scheduled for 15 October 2023 (Resolution of the PKW No. 211/2023 of 25 September 2023), lodged by entities entitled to conduct the referendum campaign, referred to in Article 48(1) of the Act of 14 March 2003 on the nationwide referendum (I NSW 70/23 and I NSW 72/23).

On 19 September 2023, the Supreme Court upheld a complaint lodged by the Izba Gospodarczo Handlowa against a resolution of the National Electoral Commission refusing to issue it a certificate of the entitlement to participate in the referendum campaign in programmes of public radio and television broadcasters.

On 7 September 2023, the Supreme Court found complaints against the resolution of the National Electoral Commission (PKW) of 30 August 2023 regarding clarifications on the authority of persons of trust and social observers to be justified and ruled that both the person of trust and the public observer have the right to be present during all activities of the electoral and referendum commission to which they are appointed, including prior to voting day.
