Sędziowie Sądu Najwyższego zebrani na Zgromadzeniu Ogólnym w dniu dzisiejszym podjęli jednogłośnie następujace uchwały:

My, sędziowie Sądu Najwyższego, uczestniczący w Zgromadzeniu Ogólnym Sędziów Sądu Najwyższego w dniu 28 czerwca 2018 roku, pamiętając o złożonym ślubowaniu sędziowskim i wierni Konstytucji RP, która jest najwyższym prawem Rzeczypospolitej Polskiej, stwierdzamy, że sędzia Sądu Najwyższego prof. dr hab. Małgorzata Gersdorf pozostaje – zgodnie z bezpośrednio stosowanym art. 183 ust. 3 Konstytucji RP (art. 8 ust. 2 Konstytucji RP) – do dnia 30 kwietnia 2020 roku Pierwszym Prezesem Sądu Najwyższego, kierującym instytucją, w której pełnimy naszą służbę społeczeństwu.

Niezgodna z art. 180 ust. 1 Konstytucji RP regulacja zawarta w art. 111 § 1 ustawy o Sądzie Najwyższym z dniem 4 lipca 2018 r. usuwa ze składu Sądu Najwyższego znaczną liczbę sędziów. Stanowi to oczywiste naruszenie przez władzę ustawodawczą jednej z podstawowych gwarancji niezależności sądownictwa i już w najbliższym czasie istotnie zakłóci normalne funkcjonowanie Sądu Najwyższego. Sędziowie, którzy rozpoczęli służbę w Sądzie Najwyższym przed dniem wejścia w życie ustawy z dnia 8 grudnia 2017 r. o Sądzie Najwyższym, powinni pełnić tę służbę do ukończenia 70 roku życia, bez spełnienia jakichkolwiek dodatkowych warunków.

We, the justices of the Supreme Court, attending the General Assembly of the Justices of the Supreme Court held on 28 June 2018, mindful of the oaths of office we made and allegiant to the Constitution of Republic of Poland, which is the supreme law of the Republic of Poland, state that Justice of the Supreme Court, Professor Małgorzata Gersdorf, PhD, D.Sc., shall remain – according to Article 183 section 3 of the Constitution of the Republic of Poland directly applied under Article 8 section 2 of the Constitution of the Republic of Poland – the First President of the Supreme Court, heading of the institution in which we perform our service to the public, by 30 April 2020.

Being inconsistent with Article 180 of the Constitution of the Republic of Poland, regulation provided in Article 111 paragraph 1 of the Act on the Supreme Court, removes, on 4 July 2018, a large number of justices from the Supreme Court. It constitutes obvious violation by the legislature of one of the fundamental guarantees of independence of the judiciary and will soon significantly disrupt normal functioning of the Supreme Court. Justices who had begun their service on the Supreme Court before the Act of 8 December 2017 on the Supreme Court came into force, should continue such service until the age of 70 without any additional conditions.
